1. Acceptance of Terms

By accessing or using FreshTalent (the “Platform”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our service.

2. Services Provided

FreshTalent connects companies (“Clients”) with pre-vetted remote African professionals (“Talent”) across all roles and industries. We provide candidate matching, vetting, introductions and ongoing support.

3. Client Obligations

• Provide accurate job requirements and hiring timeline
• Conduct interviews and make hiring decisions fairly
• Pay the agreed placement fee upon successful hire
• Provide a positive, respectful working environment for hired Talent

4. Placement Fees & Payment

Clients pay a one-time placement fee only upon successful hire. No upfront fees or retainers. Fees are 100% success-based.

Payment is due within 7 days of the hired Talent’s start date. Accepted methods: bank transfer, Wise, PayPal, USDT/USDC.

5. Replacement Guarantee

If a placed Talent leaves or is terminated for performance reasons within the first 3 months, FreshTalent provides one free replacement or a full refund of the placement fee.

6. Candidate Ownership

Once hired, the Talent becomes a direct employee/contractor of the Client. FreshTalent has no ongoing employment relationship with the Talent.

7. Confidentiality

Both parties agree to keep all shared information confidential. FreshTalent will never share Client data with third parties without consent.

8. Limitation of Liability

FreshTalent is not responsible for the actions of hired Talent post-hire. We provide vetting and matching services only.

9. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes will be resolved through arbitration in Nairobi.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Platform constitutes acceptance of the updated terms.
